A man serving time for killing a Rockmart man wants to withdraw his guilty plea, but will have to wait to make his case in court.

Tyson Wilson, one of the two men convicted in the case, was set to appear in court Tuesday to withdraw his plea in the September 2008 shooting death of Ronny Ferguson, 49, in his Rockmart home.

However, officials said his attorney was tied up in a trial in another county so the hearing had to be continued.

Wilson, now 33, was the alleged triggerman in the incident at 422 Long Avenue, Rockmart. Two others, Alfred Fennell and Melissa Henderson-Smith, were also shot in the incident. Both were in court Tuesday.

The charges Wilson pleaded to are felony murder, aggravated assault with a dangerous weapon and possession of a firearm during the commission of a crime.

Wilson’s plea came in the middle of his trial in 2009 after Fennell testified that Wilson had the gun used to kill Ferguson.

The plea occurred before Henderson-Smith, had a chance to testify and amid rumors that Kionte Rashad Glover, the 17-year-old with Wilson during the incident, could testify against Wilson.

Glover, who was convicted on multiple charges in an April 2009 trial relating to the shooting, had not been sentenced at the time of Wilson’s trial. His sentencing was delayed, leaving open the opportunity to negotiate a lighter sentence in exchange for testimony against Wilson.

Glover was sentenced in May 2009 to life plus 25 years on charges that include felony murder, three aggravated assault charges, and a firearms charge.
