An Aragon man accused in the shooting death of his wife was indicted last week by the Polk County Grand Jury, according to court records.

Shay Alexander Merritt, 31, of 11 East 2nd St., Aragon, was indicted on malice murder, felony murder, aggravated assault under the Family Violence Act (FVA), possession of a firearm during the commission of a felony, and cruelty to children in the first degree.

Merritt’s wife, Rita Merritt, 27, of the same address, was shot to death in their Aragon apartment September 17, 2011. At least one of their children was reportedly home at the time, according to reports.

Reports state Merritt called 911 at 11:40 p.m. claiming his wife had attempted a suicide. Emergency crews arrived to find Rita Merritt dead.

The GBI handling the case at the time said an investigation pointed away from suicide and Merritt reportedly confessed to the killing before the night was over.

Merritt was released on $150,000 bond in February. According to the law, a person can only be incarcerated up to 90 days without bond or an indictment.
