The three civil cases expected to go to trial in September are in a legal limbo, according to records at the Polk County Clerk of Superior Court’s office.
Two of the cases involve property disputes and one involves injuries sustained in a traffic accident.
At this point, lawyers are submitting motions and other paperwork for discovery.
Highlights of those cases are:
Sherry and Jeff Dunn and Barry and Wanda Cole are locked in a legal battle over an oral agreement involving the rent and use of the Biker’s Alley Restaurant at 2491 Morgan Valley Road, Rockmart.
The restaurant wasn’t allowed to open because of an inadequate sanitation sewage system. The Dunns, who had rented and renovated the property are seeking a total of $105,000 in damages.
The Coles said in court documents the Dunns were aware the agreement was for the building “as is.”
Juan Hernandez is suing Anthony Carnes, Nova Robinson Chandler, Barbara Bordynoski and the City of Cedartown over who should own 1.6 acres of land on the south side of West Avenue near Fourth Street.
Hernandez claims in court documents he made payments and paid taxes on the property. After a mix up with the City of Cedartown over taxes, Hernandez said in documents he asked Carnes to continue with the prior arrangement and payments, but Carnes refused.
Hernandez is suing to force the contract be honored.
Carnes said Hernandez breached the contract and filed a countersuit asking for clear possession of the property and $70,000 for unpaid rent and payments.
Richard, Cynthia and Katherine Hassell are suing driver Roger Grant and R.A. Adams Construction Inc., after Grant rear-ended the Hassell’s car at State Road 20 and 1 Loop Road in Rome.
The Hassells, of Rome, but sued here because the construction company is based in Cedartown.
All three said they suffered injuries and are seeking payment for their past and future medical treatment, lost wages and attorneys’ fees, although an exact sum was not named in the suit.
Grant and the construction company maintain in court records that neither is guilty of negligence.
